No, that's someone wearing the Ben Reilly version of the Spider-Man costume, the one that Reilly wore during the Dan Jurgens The Sensational Spider-Man run.

In continuity, this was when Ben took over from Peter as Spider-Man to allow Peter time to spend with Mary Jane during her pregnancy. I don't remember anyone wearing that costume during Civil War,though, but perhaps I wasn't paying attention.
